1.5% Aboriginal participation

For NSW Government contracts above the Aboriginal Participation threshold, suppliers must allocate at least 1.5% of contract value to Aboriginal participation, including through subcontracting. As a recruitment agency, do we carry Privacy Act obligations independently of our clients?

Yes. Recruitment agencies are data controllers in their own right under the Privacy Act 1988, separately from the Government agencies they serve. Every time a consultant records an interview, they are collecting personal information subject to APP 3 for consent, APP 6 for purpose limitation, APP 8 for cross-border disclosure and APP 11 for security. Nguma captures consent automatically at the start of every session, holds candidate records in Australia, and logs every access event.

Does Nguma screen or rank candidates for us?

No. Nguma does not screen, score, rank or filter candidates at any stage, and it has no capability to do so. It structures what candidates submitted so your consultants can assess faster, and records who decided what, when and on what basis.
